有组织科研的“一强化、两加快、两提升、四推进”重点举措,目标在于加快推进关键技术研发、科技成果转化、科技力量建设、科研评价机制改革等方面的创新发展。在有组织科研推进过程中,存在组织机制、创新的法治保障与激励、科学家权益保护、“有组织科研”与“自由式探索”的关系协调等方面的问题。有组织科研相关问题的法治解决路径主要包括:署名问题的知识产权法治应对;以有组织的科研法人模式打通产学研全过程;完善科学家权益的法治保护机制;构建“有组织科研”与“自由式探索”相互协调的法治保障进路。
In the current era of big data, the development and construction of a digital society needs to adapt to the modernization of social governance system and governance capacities and then promote and realize scientific and technological governance through scientific and technological innovation and organized scientific research. Generally speaking, promoting "organized scientific research" is an important path for China to achieve a high level of self-reliance and self-improvement and build a world science and technology power. Notwithstanding its significance, there are challenging issues in the practice of organized scientific research. For instance, there are research projects guided by top researchers who contribute mainly by attracting public attention and gaining government trust, but by the end, it is difficult to produce satisfactory results. Some projects whose importance cannot be shown for a while or that are not suitable for large-scale operation may be marginalized and thus cannot stimulate the innovative spirit of research groups and scientists, making it impossible to integrate production, education and research together. Thus, there is an urgent need to verify the path, mechanism and method of the rule of law and the content of the rule of law in modern scientific research.
The main characteristics of organized scientific research are mainly manifested in its organization, its research frontiers, and its comprehensiveness. From the perspective of risk governance, organizational legitimacy is the core content of benign organizational development. Due to the uncertainty and contingency of research, both overorganization and liberalization are not conducive to the realization of national strategies for organized scientific research. The mode mismatch among the scientific research organization, the scientific research production, and the inappropriate evaluation are one of the important reasons why Chinese universities are still insufficient in promoting original innovation, solving bottleneck problems, and responding to major social needs. The resource allocation mode, the management and evaluation system that unify the scientific research production mode, and the scientific research output goal of colleges and universities are key elements to accelerate the implementation of the innovation-driven development strategy, strengthen the important role of university scientific research in serving economic and social development, and carry out logical reform and innovation on the premise of deeply grasping the diversified historical evolution of the organizational forms and methods of scientific research and production in colleges and universities. By adopting the key measures of "strengthening, accelerating, improving, and advancing" organized scientific research, it is aimed to accelerate the innovative development of key technologies, the transformation of scientific and technological achievements, the construction of scientific and technological forces, and the reform of scientific research evaluation mechanisms. In the process of promoting organized scientific research, there are organizational mechanism issues, requiring innovative legal guarantees and incentives, the protection of the rights and interests of scientists, and the coordination of the relationship between "organized research" and "free exploration".
Hence, it is advocated to examine through institutionalized and rigid rule of law systems , reflect on the reflexive legitimacy and externality legitimacy of scientific research, focus on organizational factors, innovation factors, subjectivity and externalities, and ensure academic democracy and academic authority, academic freedom and organization, scientific uncertainty and technical purpose, expert decision-making and the coordination of multiple interest communities. Furthermore, because the rule of law solution path for organized scientific research problems mainly includes the intellectual property rule of law response to the issue of authorship, it is necessary to open up the whole process of "production, learning and research" with the model of an organized scientific research legal person, improve the mechanisms for protecting the rights and interests of scientists under the rule of law, and build a coordinated approach to the rule of law with "organized scientific research" and "free-style exploration". In summary, taking organized scientific research as the research object, this paper delves into the main problems, especially legal issues, in the implementation of organized scientific research, and then constructs a legal guarantee path for organized scientific research, and provides a rule of law solution for problems related to organized scientific research.
