Abstract At present, artificial intelligence(AI) has gradually transformed itself from creation tools to selfcreation, which has challenged the "inventor" role.Can AI be the "inventor"related to the creation of the ownership of rights，patent examination procedures，patent licensing and other systems.Using literature research，historical research，logical reasoning and other methods to analyze from different dimensions: AI will have the "invention"of the ability to consciousness, the future will become a legal "human"there is no theoretical obstacles.However, if AI is to become an "inventor", not only the entire society must form a consensus, but also there must be sufficient reasons to amend the patent law.From the perspective of the patent system, AI has become an "inventor"does not meet the objectives of the patent law ,There are also obstacles to the implementation of AI.At present, there is an urgent need to resolve the ownership of the rights of AI creation.In response to the challenge, we should adhere to the basic provisions of the "inventor" in the patent law, but we can require the applicant to fulfill its obligation to explain the contribution of AI.
