Can Repeated Alliance of Patent Pool Reduce Patent Litigation Between Partners |

Abstract There is a phenomenon of co-opetition among enterprises in the patent pool.Can repeated alliance of patent pool reduce patent litigation between partners? Based on the theory of co-opetition,the paper introduces the perspective of alliance learning,and analyzes the influence mechanism of inter-enterprise patent litigation in patent pools,and chooses 64 companies in 12 patent pools in MPEGLA as sample,using negative binomial regression model to prove the impact of repeated alliance,exploratory cooperation,and alliance learning on the intensity of patent litigation between enterprises in patent pools.The results show that the enterprise reduces the intensity of patent litigation against other enterprises in patent pools as the exploratory cooperation level increases,while increases as the number of repeated alliances,the intensity of alliance learning increases.This study not only provides a new analytical perspective for the patent pool,but also provides valuable suggestions for enterprises on how to develop patent pool,utilize and prevent patent litigation effectively.
